Terms of Service

These Terms of Service govern your use of floridalegaltitle.com (the “Site”), operated by Florida Legal Title (“we,” “us,” or “our”). By using the Site, you agree to these terms. If you do not agree, do not use the Site.

This is the most important section on this page.

  • Content on this Site is general information about title, escrow, and closing services. It is not legal advice.
  • Using this Site, submitting a form, or sending us an email does not create an attorney-client relationship.
  • An attorney-client relationship is created only by a signed written engagement agreement with us.
  • Do not send us confidential or time-sensitive information through this Site until we have confirmed in writing that we can represent you. Information you send before that point may not be protected by attorney-client privilege and we may already represent an adverse party.
  • Laws change and outcomes depend on specific facts. Do not act on anything you read here without consulting a qualified professional about your situation.

2. No title, escrow, or insurance relationship created by the Site

  • Submitting a form or requesting an estimate does not open a title order, create an escrow relationship, or bind us to provide services.
  • Nothing on this Site is an offer to issue title insurance, a commitment to insure, or a binder.
  • Title insurance is issued only under a written commitment and policy from the underwriter, subject to its terms, conditions, and exceptions.
  • We become your settlement or escrow agent only after we have accepted an order and, where applicable, received signed escrow instructions.

3. Closing cost estimates

Our closing cost estimator and any figures we provide through the Site are estimates only.

  • Estimates are not a quote, a guarantee, or a Closing Disclosure.
  • Actual costs depend on the contract, the property, the lender, the county, current recording fees and taxes, and the underwriter’s rates.
  • Only a written settlement statement or a lender-issued disclosure reflects your actual figures.
  • We are not liable for decisions made in reliance on an estimate.

4. Communications and information security

  • Email and web forms are not secure. Do not transmit Social Security numbers, account numbers, wire details, or images of identification documents through them. Request a secure upload link instead.

We will never send changed wire instructions by email. Verify all wire instructions by phone at a number you independently confirm before sending funds. See our Privacy Policy for more detail.

  • You are responsible for the accuracy of information you submit to us.

5. Permitted use of the Site

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to the Site, our systems, or any account
  • Scrape, harvest, or copy Site content by automated means without our written permission
  • Introduce malware or interfere with the Site’s operation
  • Misrepresent your identity or affiliation
  • Use Site content to build a competing service or to send unsolicited commercial messages

6. Intellectual property

The Site and its content, including text, layout, graphics, logos, and design, are owned by us or our licensors and are protected by copyright, trademark, and other law.

  • You may view and print pages for your personal, non-commercial use in connection with a transaction.
  • You may not reproduce, republish, distribute, or create derivative works from Site content without our prior written consent.
  • “Florida Legal Title” and our logo are our marks. Other names and marks on the Site belong to their respective owners.

The Site links to resources we do not control, including lender portals, county records systems, and mapping services. We provide these for convenience only. We do not endorse them, we do not control their content, and we are not responsible for their accuracy, availability, or privacy practices.

8. No warranties

The Site is provided “as is” and “as available.”

  • We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
  • We do not warrant that Site content is accurate, complete, or current.
  • To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Nothing in this section limits any obligation we have under a signed engagement agreement, escrow instructions, or an issued title insurance policy. Those documents control the services we actually provide.

9. Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Site, including lost profits, lost data, or business interruption.
  • Our total liability for any claim arising from the Site will not exceed [$100.00 / the amount you paid us for services related to the claim, whichever is greater].
  • These limits apply regardless of the theory of liability and even if we were advised of the possibility of the damages.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold us and our members, employees, and agents harmless from any claim, loss, liability, or expense, including reasonable attorney fees, arising from your misuse of the Site, your violation of these terms, or your violation of any law or third-party right.

11. Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any action relating to the Site will be brought exclusively in the state or federal courts located in Alachua County, Florida. You consent to that jurisdiction and venue.

12. Changes to these terms

We may revise these terms at any time. Revisions take effect when posted with an updated “Last updated” date. Continued use of the Site after a revision means you accept it. Review this page periodically.

13. Severability and waiver

If any provision of these terms is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it.

14. Entire agreement

These terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. They do not modify or replace any signed engagement agreement, escrow instructions, closing documents, or title insurance policy, each of which controls its own subject matter.
