Florida Legal Title (“we,” “us,” or “our”) respects the privacy of the people who visit our website and the people whose information we handle in a real estate transaction. This policy explains what we collect, how we use it, and who we share it with.
Because we act as a title insurance agency and settlement agent, we are treated as a financial institution under federal law. That means the information we handle in a closing is subject to stricter rules than ordinary website data. This policy addresses both categories separately.
1. Two kinds of information
Website information. Data collected when you browse floridalegaltitle.com, submit a form, use our closing cost estimator, or call the number listed on the site.
Transaction information. Nonpublic personal information (“NPI”) we receive when you are a party to a closing, escrow, or title order. This includes financial and identifying details required to complete the transaction.
The protections that apply to transaction information are described in Section 6.
2. Website information we collect
Information you give us:
- Name, email address, phone number, and mailing address
- Property address and transaction details you enter in a form
- Any message, question, or document you send us
- Information you provide in the closing cost estimator
Information collected automatically:
- IP address, browser type, device type, and operating system
- Pages visited, time on page, referring URL, and links clicked
- Cookie and analytics identifiers
Information from third parties:
- Referral information from a real estate agent, lender, or attorney who submits your details to us
- Basic business information from map, review, and advertising platforms
3. How we use website information
- Respond to your inquiry, quote request, or estimator submission
- Open and process a title or escrow order
- Communicate about a transaction you are part of
- Improve site performance, navigation, and content
- Measure marketing effectiveness
- Detect fraud and secure our systems
- Meet legal, regulatory, and recordkeeping obligations
We do not sell your personal information.
4. Cookies and analytics
We use cookies and similar technologies to operate the site and understand how it is used. Categories:
- Essential. Required for the site to function. These cannot be disabled.
- Analytics. Aggregate usage measurement, including [Google Analytics 4].
- Advertising. [If applicable: Google Ads and Meta advertising tags used to measure conversions and show ads.]
You can block or delete cookies through your browser settings. Some features may not work correctly if you do.
We do not respond to browser Do Not Track signals, because there is no common industry standard for them.
Third-party tools operate under their own privacy policies. This includes [Google Analytics], [the Google Maps embed on our contact page], and [any scheduling or chat tool].
5. Who we share information with
We share information only as needed to complete a transaction or run our business:
- Title insurance underwriters issuing your commitment and policy
- Lenders and mortgage servicers involved in your loan or payoff
- Real estate agents and attorneys representing parties to the transaction
- Search, abstract, lien search, survey, and estoppel vendors performing work on your file
- County clerks, recorders, and tax collectors for recording and tax purposes
- Banks holding escrow and trust accounts
- Technology and service providers for hosting, email, e-signature, document storage, and accounting
- Professional advisors including our auditors and counsel
- Government and regulatory authorities when required by law, subpoena, or court order
We require service providers to protect the information we give them and to use it only for the purpose we provided it.
6. Transaction information and your GLBA notice
If you are a party to a closing, escrow, or title order, we collect NPI such as:
- Social Security number or taxpayer identification number
- Bank account and wire transfer details
- Government-issued identification
- Loan, payoff, income, and asset information
- Marital status and information about title holders and heirs
How we treat it:
- We collect only what the transaction, our underwriter, or applicable law requires.
- We do not sell NPI.
- We do not share NPI with nonaffiliated third parties except as permitted or required by the Gramm-Leach-Bliley Act and applicable state law, including sharing necessary to process, service, and close your transaction.
- We retain NPI for the period required by our underwriter, Florida law, and applicable federal law.
- We maintain administrative, technical, and physical safeguards designed to protect NPI, consistent with the FTC Safeguards Rule and ALTA Best Practices.
7. Wire fraud warning
Real estate closings are a primary target for wire fraud. Please read this carefully.
- We will never send you a change to wire instructions by email.
- Before sending funds, call our office at (352) 745-7300 using a number you have independently confirmed and verify the instructions verbally.
- Treat any emailed change of account, routing, or beneficiary information as fraudulent until you have verified it by phone.
- Do not send Social Security numbers, account numbers, or images of identification documents by unencrypted email. Ask us for a secure upload link.
8. Data security
We use reasonable administrative, technical, and physical safeguards to protect information in our possession, including access controls, encryption in transit, secure document portals, employee training, and vendor oversight.
No system is completely secure. We cannot guarantee that unauthorized access will never occur. If a security breach affecting your personal information occurs, we will notify you as required by the Florida Information Protection Act and other applicable law.
9. Retention
We keep information for as long as needed to complete your transaction, meet our recordkeeping and audit obligations, resolve disputes, and comply with law. Closing files are retained for the period required by our underwriter and applicable Florida law, and then destroyed securely.
10. Your choices
- Marketing email. Use the unsubscribe link in any marketing message, or contact us. We may still send you transactional messages about an open file.
- Access and correction. You may ask us for a copy of the personal information we hold about you, or ask us to correct it. Contact us using the details below. Some records cannot be altered or deleted because we are required to retain them.
- Cookies. Manage these in your browser settings.
Florida’s comprehensive consumer privacy statute, the Florida Digital Bill of Rights, applies only to businesses above a very high revenue threshold and does not apply to us. If you live in a state with a privacy law that gives you additional rights, contact us and we will respond as that law requires.
11. Children
Our website is not directed to children and we do not knowingly collect personal information from anyone under 13. If you believe a child has provided us information, contact us and we will delete it.
12. Third-party websites
Our site links to sites we do not control, including lender portals, county records sites, and mapping services. We are not responsible for their content or privacy practices. Review their policies before providing information.
13. Changes to this policy
We may update this policy. When we do, we will revise the “Last updated” date above. Material changes will be posted on this page. Continued use of the site after an update means you accept the revised policy.
